1. Scope and parties
These terms govern the use of Dconnect, a Bitrix24 application provided by Dresultado Data Solutions Ltda, CNPJ 36.233.896/0001-04 ("Dresultado"), to the company that installs it ("company"). By installing or using Dconnect, the company accepts these terms and the Privacy Policy. Where a commercial agreement or data processing agreement has been signed between Dresultado and the company, those documents prevail over these terms in case of conflict.
2. The service
Dconnect connects the company's WhatsApp Business account and Instagram professional account to its Bitrix24: it receives and sends messages, shows conversations in an inbox inside Bitrix24, links conversations to CRM records and provides an API and webhooks for the company to integrate its own systems.
3. The company's accounts and data
The company owns its Meta business portfolio, WhatsApp Business account, phone numbers, Instagram professional account, Bitrix24 portal and its Meta and Bitrix24 billing. Dresultado receives access only to operate the service. All contact, conversation and history data belongs to the company.
4. The company's responsibilities
The company agrees to:
- have a legal basis to process the data of contacts who reach it through the connected channels;
- clearly inform its contacts how it processes their data, including when it uses automated service;
- send outbound messages, such as message templates, only to people who agreed to receive messages on the channel, and immediately honor opt-out requests;
- follow WhatsApp, Instagram, Meta and Bitrix24 policies;
- define which team members see which conversations and keep access up to date;
- protect the API keys and webhook addresses it registers in Dconnect;
- handle data subject requests, with Dresultado's support.
5. Prohibited use
Dconnect may not be used to send bulk messages without permission, misleading or illegal content or content that violates Meta or Bitrix24 policies, to attempt to access other companies' data, or to bypass the service's technical and security limits.
6. Dresultado's responsibilities
Dresultado is responsible for operating the service under these terms and the agreement, for the security of the processing it performs as a processor, for notifying the company of incidents within 72 hours of becoming aware of them, and for support at suporte@dresultado.com.
7. Third-party dependency
The service depends on Meta, Bitrix24 and other providers. Changes, outages or suspensions by those providers may affect the service. Dresultado informs the company and assesses the impact, without guaranteeing those providers' service levels.
8. Pricing
Dconnect prices are those stated at purchase or on the application listing. Meta fees for WhatsApp conversations and Bitrix24 licenses are paid by the company directly to those providers.
9. Suspension
Dresultado may suspend access in case of breach of these terms, use that puts the company's Meta accounts or data subjects' data at risk, non-payment, or legal obligation, notifying the company whenever possible.
10. Termination and exit
The company may terminate at any time by disconnecting its channels and uninstalling the application from Bitrix24, subject to any notice period in the agreement. The company may request an export of its data within 15 days after termination, and Dresultado deletes its own copies within 60 days, except where the law requires retention. Conversations recorded in Bitrix24 remain in the company's portal.
11. Limitation of liability, governing law and venue
Dresultado's liability to the company is limited to the amount paid by the company for Dconnect in the 12 months before the event, except for willful misconduct or gross negligence and except for legal data protection obligations that cannot be limited. These terms are governed by Brazilian law. The courts of São José, SC, Brazil, have jurisdiction.
12. Changes
We may update these terms. The version date is shown at the top of the page. Relevant changes are communicated to companies in advance.
This English version is provided for convenience. If there is any conflict, the Portuguese version prevails.
